I send out a Terms, Conditions and Overview of Services that the client has to agree to before I do anything. Once they agree, I send them an invoice for the first half upfront and the discovery document. Research starts soon as I get the upfront payment and the completed discovery document back. The Terms, Conditions and Overview goes over payments, including how the Copyright doesn't transfer until after I have received the second half of the total cost. Until the logo is paid for in full, I own the Copyright and the legal right to resell it. In addition it is explained how if they don't like any of the ideas presented, they aren't out another penny. They aren't required to pay the second half as long as they don't use any of the ideas presented. The Terms, Conditions and Overview I send out also goes over, briefly, how the logo design process works and outlines all the free stuff I throw in if they stick it out. One freebie is I become a defacto guard dog of their copyright and help them fight anyone who may steal it. The Terms, Conditions and Overview of Services has scared off a potential client or two, but, for the most part, I've been happy with how it has been received so far. Clients need to know that you are a business person as well as an artist, and the rules protect both the client and the artist.
