Not sure what's wrong with design being controversial, those are the ones that stick out, no?
I like this very much, even though it's experimental - I can image this working very well for - thinking out loud - a lounge called "the black bar"... but that's just my opinion.

Also Tomato's reactive identity for TV Asahi comes to mind - they did add the name but took the bar one step further by putting it in a different position for every application.

Interesting point mister. I said you couldn't TM "a" black bar. I did not say you couldn't trademark "a specific arrangement of black bars of varying lengths used consistently in a particular layout" as Amatterofdesign%u2122 has done. But can you?
I would argue these covers are parodies of the actual text cover with the TM left there to drive the connection. Can the singular box replacing "Amatterofdesign", ON ITS OWN, be a defensible trademark? I've often found you cannot own a common shape unless in context with something proprietary.

Immediately recognizable and most often used as a stand alone graphic. But it only has a mark (in this case a registration mark) when coupled with its text. Do they own a trademark on the graphic itself? Can they own a common "equal" sign? Or do the colors, layout and proportions in relation to the box make it trademarkable. I dunno.
of course you can't trademark it, i just thought i'd throw in the victionary book covers after i saw them on my desk and remembered this thread. hehe
Anyway, there's already a black bar logo, made by Coast design in Sidney. It's for an art gallery ("like a gallery, the logo presents a space to be transformed"), and it's used without the name of the gallery (phatspace), but without the TM...
